TERMS AND CONDITIONS OF USE OF ADRIATIC PRIVILEGE CARD
1. Subject and provisions
1.1. The following Terms and Conditions of Use ("Terms of Use") of Adriatic Privilege Card ("APC Card") are setting the contractual terms between the Limited Liability Company JADRANSKA TURISTIČKA KARTICA d.o.o. ("JTK") and Individual, who has bought and is using Adriatic Privilege Card issued by JTK, from the time the User buys or receives APC Card.
1.2. If not stated otherwise in Terms of Use, the terms that appear in this paragraph, are defined in Terms of Use as stated in following lines:
APC Card: the APC Card is a product of JTK and is accepted as means of the User receiving discount on many services, accommodations, hospitality services etc., on points of sale.
User: an Individual or Legal Entity, that has bought, correctly filled the APC Card and is using the APC Card in the time of its validity.
Points of Sale: place of sales of goods and services, where the APC Card is accepted as means of receiving discount with purchase, whether the Point of sales is a Legal Entity, Craftsman, or any other business subject.
2. The issue of APC Card and validity
2.1 Every Individual or Legal Entity, be domestic or foreign, is entitled a right to purchase the APC Card, in places, where JTK has confirmed business cooperation of selling APC Card (tourist agencies, hotels, post offices, news-stands etc.), and use of so purchased APC Card on Points of Sale.
2.2 The APC Card is being sold by unified price of 120,00 Croatian Kuna (HRK) at all selling points; JTK reserves the right to change this price in future.
2.3 The APC Card is valid for 10 days after first use of the Card.
2.4 The APC Card may not be used after expiry of validity. The User is liable to cover any cost and damages that might have incurred due to use of expired APC Card.
2.5 In case that the User wishes to return the APC Card after it was purchased, regardless if the Card has been or has not been used, the User is not entitled to any reimbursement or compensation.
2.6 In case there are any noticeable damages or traces of erasing or any subsequent changes to Card Holder's Name, Last name or Validity date on the Card, the APC Card becomes void; consequently Points of Sale are not in any way obliged to approve a discount on its services.
3. The Use of APC Card
3.1 Before first use, The User is required to fill on the Card his or hers Name and Last name, the date of first use and date of last possible use (for instance 5.5. - 15.5. and year ). Only the User whose Name is written on the APC Card may use the APC card accordingly to Terms of Use. The User may not transfer the APC card to a Third Party, and bears full responsibility in the event of unauthorized use of APC card in his name.
3.2 The User authorizes the Point of Sale, that when using the APC Card, the Point of Sale may check his identity. At the request of Point of Sale, the User will show his identity card or passport.
3.3 The APC Card is used as a means to receive a discount at the payment of goods and services at Points of Sale, under the conditions defined by Point of Sale.
3.4 The APC Card provides discount only for one person, which is the User of the card, with the exception of paying for hospitality services when the discount can be applied to single Invoice, regardless of the number of persons.In the case of payment of accommodation in hotels and resorts,the discount applies to one person or apartment, regardless of the number of beds, if the hotel doesnot decide otherwise.
3.5 For the duration of validity of the APC Card, the User is entitled to unlimited use of discounts in different Points of Sale.
3.6 The User is entitled to discounts in Points of Sale, only when his APC Card is valid at the time of purchasing goods or services.
3.7 Booking discounts apply only in cases where the reservation is made directly with the hotel / camp / resort via phone or e-mail; and is not valid in any case for on-line bookings.
3.8 Discount on accommodation (hotels, camps, resorts, etc.) does not apply to existing discounts and special offers, and it cannot be combined with similar discounts.
4. Liability for incurred costs due to unauthorized use of the APC Card
4.1 In the case of costs and the difference of value between discounted and regular price of service or goods that have incurred due to unauthorized use of the APC Card by the Third Party, the User is liable to Point of Sale solidarily with the Third Party.
5. Complaint
5.1 The User will deal exclusively with Points of Sale any and all possible disagreements and disputes about the quality and delivery of goods and/or services of Points of Sale, or on the point of material and legal shortages of the goods and/or services of Point of Sale. JTK does not accept any liability or responsibility for the damages incurred to the User, as a consequence of non-compliance or partial compliance of obligations of Points of Sale.
5.2 JTK does not accept any liability for accuracy of data on quality or price of goods and/or services, that Points of Sale advertise on their Web pages or in brochures which JTK receives from Points of Sale and publishes on its own Web page or brochure; or which Points of Sale hand over to JTK for marketing purposes on JTK's Web pages and brochures.
5.3 The User will deal exclusively with Points of Sale and JTK does not accept any liability on complaints about services of Points of Sale, and also any and all possible disagreements and disputes about the quality of goods and / or services of Points of Sale, or on the point of material and legal shortages of the goods and / or services of Points of Sale.
6. Changes to Terms of Use
6.1 JTK reserves the right to change the Terms of Use, and will publish the information about any changes to Terms of Use on its web page: www.adriaticprivilegecard.com
6.2 If the Terms of Use confirm that terms and conditions of use of APC Card can change in accordance to act of compensations and other JTK internal acts, the change of terms and conditions of use is not necessary. JTK will publish the information about such acts on its web page: www.adriaticprivilegecard.com
6.3 The User agrees to JTK publishing Terms of Use and any and all changes to it, on web page www.adriaticprivilegecard.com. The User commits himself to regular monitoring of the contents of that page in order to timely get to know all the ordinances and their changes.
7. Entry into force
7.1 The Terms of use come into force on March 31, 2010
